These Terms of Service (“Terms”) govern your access to and use of the HandyTECH website, operated by HandyTech, LLC, and the services we provide through it (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Use of the Services
You may use the Services only in compliance with these Terms and all applicable laws. You are responsible for any activity that occurs under your account and for keeping your login credentials secure. You agree to provide accurate information and to keep it up to date.
Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose
- Attempt to gain unauthorized access to any account, system, or data
- Interfere with or disrupt the integrity or performance of the Services
- Infringe the intellectual property or privacy rights of others
Accounts
Some features require an account. You must be able to form a binding contract to create one. We may suspend or terminate accounts that violate these Terms or that are used in a manner that risks harm to us or others.
Services, training, and orders
Descriptions of services, training, and pricing on the site are for general information and may change. A binding agreement for paid services is formed when we confirm your order or appointment. Specific engagements may be subject to a separate written agreement, which will control in the event of any conflict with these Terms.
Payments and refunds
When online payments are enabled, fees are due as described at the time of purchase and are processed securely by our payment provider (Stripe). Unless otherwise stated in writing or required by law, payments are non-refundable once the related service or training has been delivered. Any applicable taxes are your responsibility.
Intellectual property
The Services, including text, graphics, logos, and software, are owned by HandyTECH or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works without our permission.
Disclaimer of warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure.
Limitation of liability
To the fullest extent permitted by law, HandyTECH will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services giving rise to the claim in the twelve months before the claim arose.
Indemnification
You agree to indemnify and hold harmless HandyTECH from any claims, damages, or expenses arising out of your misuse of the Services or your violation of these Terms or applicable law.
Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Virginia will have exclusive jurisdiction over any dispute arising from these Terms or the Services, except where applicable law provides otherwise.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
