These Terms of Service (“Terms”) govern your access to and use of the HandyTECH website, operated by HandyTech, LLC, and the services we provide through it (collectively, the “Services”). By accessing the site, creating an account, requesting services, or accepting a quote or checkout flow, you agree to these Terms. If you do not agree, please do not use the Services.
Use of the Services
You may use the Services only in compliance with these Terms and all applicable laws. You are responsible for activity under your account, keeping credentials secure, providing accurate information, and keeping contact, billing, and authorization information current.
Accounts, age, and authority
Some features require an account. By creating an account, you confirm that you can form a binding contract or have parent or guardian permission, and that you are authorized to act for any business or organization you represent. We may suspend or terminate accounts that violate these Terms, create security risk, or are used without proper authority.
Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, or fraudulent purpose
- Attempt to gain unauthorized access to any account, system, or data
- Interfere with or disrupt the integrity or performance of the Services
- Submit passwords, payment-card numbers, health information, or regulated sensitive data through public forms
- Infringe the intellectual property, confidentiality, or privacy rights of others
Service requests and customer responsibilities
A binding agreement for paid services is formed when we confirm your order, appointment, statement of work, or other written authorization. You are responsible for backing up important data before service, maintaining software licenses, providing safe site access, ensuring you have authority over devices and accounts submitted for support, and sharing only credentials or data necessary for the work.
We do not guarantee that every issue can be fixed, that every device or system can be recovered, or that data recovery will be successful. Service-level commitments, if any, must be stated in a separate written agreement.
Remote support and client data
If you request remote support, you authorize us to access the systems, accounts, or devices you identify for the limited purpose of providing the requested service. You should close unrelated files and remove sensitive information from view before a remote session begins. Work involving regulated data, confidential business systems, protected health information, financial data, or client records may require a separate written agreement, data processing terms, business associate agreement, or other authorization before work begins.
On-site work, wireless, and regulated installation scope
Service availability varies by location and project scope. Unless expressly stated in a signed written agreement, HandyTECH does not perform electrical, structural, alarm, or regulated low-voltage work that requires a license or permit. Where permits, licensed trades, or specialized approvals are required, work will be handled according to local law, including use of licensed subcontractors when appropriate.
Appointments, cancellation, and no-shows
Appointment requests are not confirmed until we accept and confirm a time. Please notify us as soon as possible if you need to cancel or reschedule. Project-specific cancellation windows, travel fees, no-show fees, or minimum service charges will be disclosed in the applicable quote, statement of work, or checkout flow before payment or confirmed service.
Training terms
Training descriptions, prices, prerequisites, equipment requirements, seat limits, access duration, recordings, transferability, cancellation deadlines, and refund rules will be provided in the applicable course description, quote, or checkout flow. Unless stated otherwise in writing, live workshop seats are not guaranteed until confirmed, course materials are for the enrolled learner or purchasing organization only, and training content may not be copied, resold, or redistributed.
Payments, taxes, refunds, and chargebacks
When online payments are enabled, fees are due as described at the time of purchase and are processed by our payment provider, Stripe. You are responsible for applicable taxes, fees, and accurate billing information. Unless otherwise stated in writing or required by law, delivered services, completed appointments, completed training, and activated digital course access are non-refundable. Refund, cancellation, and rescheduling terms may vary by service type and will be stated before checkout or in the applicable written agreement.
Third-party products and warranties
Hardware, software, cloud services, and other third-party products are provided by their respective vendors and may be subject to separate terms, licenses, warranties, support limits, and privacy practices. We are not responsible for vendor outages, product changes, or warranty decisions by third parties.
Separate business agreements
Business-client master services agreements, statements of work, data processing addenda, business associate agreements, or other signed written agreements control over these Terms where they conflict for the covered services.
Intellectual property
The Services, including text, graphics, logos, course materials, and software, are owned by HandyTECH or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose. You may not copy, modify, distribute, resell, or create derivative works without our permission.
Advertising claims and testimonials
Credential, accreditation, performance, and testimonial references are intended to be truthful and supported by retained records. We may remove or update claims at any time to keep public information current and accurate.
Disclaimer of warranties
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, secure, or compatible with every device, system, or third-party product.
Limitation of liability
To the fullest extent permitted by law, HandyTECH will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, business, goodwill, or security arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services giving rise to the claim in the twelve months before the claim arose.
Indemnification
You agree to indemnify and hold harmless HandyTECH from any claims, damages, or expenses arising out of your misuse of the Services, your violation of these Terms or applicable law, your lack of authority over submitted systems or data, or content and information you provide to us.
Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Virginia will have exclusive jurisdiction over any dispute arising from these Terms or the Services, except where applicable law provides otherwise.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms; signup and checkout flows may also require affirmative acceptance of the then-current version.
